Crops Description
Soybean, barley, wheat, corn, sorghum, rice, peas, cassava chips, cassava chips, cassava starch, potato, sweet potato, rapeseed, Ganani grass, etc.
Prerequisite
Export access of plant-based products to China; Inspection and quarantine protocols signed and released by GACC.
Reminder
1. The Registration of Overseas Production, Processing and Storage Units of Imported Plant-Based Products applies to fresh fruit and grain products above. The registration method of primary produce does not vary with the implementation of GACC Decree 248 & 249.2. In case of export of genetically-modified (GMO) corn, soybeans, canola, etc, the exporters must apply for Safety Certificate of GMO Produce from the Ministry of Agriculture and Rural Affairs of the People's Republic of China. Each batch of GMO products must be attached with the corresponding certificate. Therefore, the GMO product, the developer's bio-safety certificate, the exporter, the importer, use of the product, and the GMO processing and utilization units must be designated. Any change of use or illegal dumping are strictly prohibited.
Legal basis: Regulations on the Safety Management of GMO Produce, Measures for the Safety Administration of the Import of GMO Produce.
Regulatory Measures:
1. The exporting countries and specific grain products shall obtain market access to China and shall be included in the Directory of Permitted Types of Grain (including Seed and Tuber Grain, Oilseeds) and Plant-derived Feed for Import and Exporting Countries or Regions;
2. Overseas manufacturing enterprises shall register with China Customs;
3. Inbound grain shall be imported from designated ports and processed in designated storage and processing enterprises of imported grain, and transported in accordance with the grain transportation mechanism and procedures of Customs;
4. Record-keeping for overseas exporters;
5. Record-keeping for Chinese importers;
6. Record-keep of import report of bulk agricultural products (for soybean, rapeseed);
Solutions for meeting the requirements of regulatory measures:
1. The exporting countries and crops shall obtain market access to China;
Solution: The intended exporting country (region) shall apply to the GACC in writing, and the GACC shall decide whether to initiate the access procedures according to the situation of plant epidemic and food safety of the exporting country (region). Once initiated, relevant questionnaires will be submitted to the intended exporting country (region). The GACC shall organize an expert panel to conduct risk assessment on the answer sheet and relevant technical data provided by the officials of the intended exporting country (region) and formulate an assessment report. In the process of assessment, the GACC can assign an expert panel to conduct field visits or verification visits to confirm the authenticity and consistency of relevant information and operations with the consent of the intended exporting country. According to the assessment results, the two sides shall consult on the inspection and quarantine requirements of the products exported to China, and determine the inspection and quarantine requirements (including the inspection and quarantine protocol, memorandum or announcement of inspection and quarantine requirements) after reaching an agreement, and confirm the content and format of the plant quarantine certificate for the products exported to China.
2. Overseas manufacturing enterprises shall register with China Customs;
Solution: Overseas manufacturing enterprises shall register with China Customs through competent authorities (non-customs cifer system). The results show that the overseas manufacturing enterprises are included in the List of Overseas Registered Enterprises Allowed to Import Grain (Including Seed Grain and Tuber Grain, Oilseed).
3. Inbound grain shall be imported from designated ports and processed in designated storage and processing enterprises of imported grain, and transported in accordance with the grain transportation mechanism and procedures of Customs;
Solution: Inquiry designated ports of entry through the official website of GACC, but it should be noted that each port is responsible for different types of grain. The transportation shall be in accordance with the grain transportation mechanism and procedures of Customs;
4. Record-keeping for overseas exporters;
Solution: Submit the application through “Internet + Customs”-“Record System for Importers and Exporters of Imported Food”.
5. Record-keeping for Chinese importers;
Solution: Submit the application through “Internet + Customs”-“Record System for Importers and Exporters of Imported Food”.
6. Record-keep of import report of bulk agricultural products (for soybean, rapeseed);
Solution: Importers can log in the import record module for bulk agricultural products of China Chamber of Commerce for Import and Export of Foodstuffs, Native Produce & Animal By-Products for record.

Solutions for attaining the information required for Customs declaration (part of information):
1. Quarantine Permit for Imported Animals and Plants
Solution: Importers shall apply for Quarantine Permit for Imported Animals and Plants at the "Quarantine Approval of Entry (Transit) Plants and Their Products" module in the administrative examination and approval items of the "Internet + Customs" (http://online.customs.gov.cn/).
2. Agricultural GMO Safety Certificate (Import) (required for GMO products)
Solution: Overseas traders shall apply to the Agricultural GMO Safety Management Office of the Ministry of Agriculture and Rural Affairs, and the application shall include the following: (1) The Registration Form of Agricultural GMO Import Safety Management (Used as raw materials for processing) (original). (Self-prepared by the applicant) (2) Agricultural GMO Safety Certificate (Import) issued by the Ministry of Agriculture and Rural Affairs (photocopy). (Self-prepared by the applicant) (3) Corresponding safety management and preventive measures (original). (Self-prepared by the applicant) (4) If an overseas trader exports an agricultural GM organism transformation from a certain country or region to China for the first time, it shall provide the license document that the exporting country or region has allowed such agricultural GM organism transformation has been used for the corresponding purpose and put on the market (official documents and Chinese translation are required). Except for those provided by overseas R&D providers in the process of import safety evaluation. (5) Those importing GM soybeans may apply for use in trade and physical delivery of futures on the premise that the final use of the commodity is raw material for processing, and tick "raw material for processing" (for trade and physical delivery of futures) in the column of "Commodity Use" in the Registration Form for Import Safety Management of Agricultural GMOs.
After the application has been approved, when applying again to the People's Republic of China, if the applicant meets the conditions of the same company and the same agricultural GMO, the application procedures for safety evaluation may be simplified and the following materials shall be provided:
(I) Registration Form for Import Safety Management (see Annex);
(II) A copy of the agricultural GMO safety certificate issued for the first time by the Ministry of Agriculture and Rural Affairs;
(III) Safety precautions to be taken by the overseas company in the process of exporting to the People's Republic of China.
After passing the examination, the Ministry of Agriculture and Rural Affairs will issue the agricultural GMO safety certificate (import).
Application principles: One-batch-one-certificate, valid for 6 months.
3. Automatic import license (required for cassava, barley, sorghum, soybean and rapeseed)
Solution: Automatic import license refers to the license certificate issued by a license-issuing organ authorized by the Ministry of Commerce to approve the import of goods subject to automatic import license administration according to law. To obtain an automatic import license, an importer shall apply for corporate record-keeping first and apply for the electronic key on the website of the Ministry of Commerce. With the electronic key, the importer can log on the website of the Ministry of Commerce to handle relevant documents. Enterprises are not required to submit their paper automatic import license for inspection during import declaration. After entering the automatic import license number, the electronic license can be checked through online verification of automatic import license, no need for paper endorsement.
