Nuts and seeds
Nuts refer to the seeds of woody plants with hard shells, including walnuts, chestnuts, apricot kernels, almond kernels, pecans, pistachios, torreya grandis, Hawaiian fruits and pine seeds. Seeds refer to the seeds of melons, fruits, vegetables and other plants, including watermelon seeds and pumpkin seeds.Nuts and seed products are processed foods made from nuts, seeds or their kernels as the main raw materials.
GACC registration conditions for overseas manufacturers of imported foods are as follows:
1. The food safety management system of the country/region where the manufacturer is located has passed GACC's equivalence assessment and/or review;
2. The manufacturer was established with approval by the competent authority of the country/region, and the manufacturer is under effective regulation by the competent authority;
3. The manufacturer has an established, effective food safety and sanitation management system and protection system, legally produces and exports food in the country/region, and ensures that foods exported to China comply with relevant Chinese laws, regulations, and national food safety standards;
4. Food exporting to China conforms with relevant inspection and quarantine requirements that have been agreed upon after discussion by the GACC and the competent authorities of the country/region.

The General Administration of Chinese Customs, overseas official regulatory agencies and production enterprises will jointly promote:

Preparing materials in strict accordance withGACC Registration Requirements and Key Checkpoints of Control and Inspection for Overseas Manufactures of Imported Nuts and Seeds Food, conduct self-assessment, and fill in the registration application form.

Submit an electronic application, fill in the enterprise elements and upload relevant materials as required; if necessary, include but not limited to floor plan of factory and workshop, process flow chart, etc.

The competent authority reviews the summary and forwards the electronic application with other support materials required by GACC.

The GACC office will review whether the materials are complete and in compliance with the legal form, and decide whether to accept it or issue a correction notice to the competent authority.

The expert group evaluates and reviews, including a combination of document review and on-site review or other reasonable review methods, and forms a review report.

Review by the General Administration of Chinese Customs whether it meets the statutory requirements and standards.

Solutions for meeting the regulatory requirements of China Customs:
1. Approval for Chinese market access of the exported goods shall be obtained;Solutions: The intended exporter (exporting region) shall file a written application to the General Customs Administration for export of dried nuts to China. The General Customs Administration will, in accordance with the general principles of Agreement on the Application of Sanitary and Phytosanitary Measures issued by WTO and depending on the conditions of plant pests and food safety in the exporter’s country(region), decide whether or not to go through the approval procedures.Once the approval procedure is started, the intended exporter(exporting region) will be sent a questionnaire and the General Customs Administration will convene an expert panel to conduct a risk assessment of the official responses and relevant technical information provided by the intended exporter(exporting region) for issuance of the assessment report. If necessary, the intended exporter (exporting region) may be suggested during the assessment to agree on on-the-spot or confirmatory investigation conducted by the expert panel to confirm the authenticity or consistency of relevant information and practices. Based on the assessment results, both parties shall negotiate about the requirements for inspection and quarantine of the products exported to China and finalize them until a consensus is reached (including conclusion of the inspection and quarantine protocols, memorandums, or release of the issued inspection and quarantine requirements), and agree on the content and format of the quarantine permit for plant products exported to China.
2. Overseas manufacturing enterprises shall register with China Customs and obtain registration number in China;
Solutions: The applicants shall file an application to the General Customs Administration via cifer registration system and meet the standards and requirements specified in the Conditions of Registration for Overseas Manufacturing Enterprises of Imported Nuts and Seeds and Key Points of Comparative Inspection; the General Customs Administration shall, upon receipt of the application, order the expert panel to conduct an assessment review on the applicants by written inspection, video inspection, on-the-spot inspection and any combined way, the qualified overseas manufacturing enterprises of the imported foods will be permitted for registration and assigned their registration numbers in China.

(Overseas manufacturers generally register according to the actual product strictly corresponding to the HS CODE, but Chinese brokers or freight agencies generally classify HS CODE according to the most preferential tax rate or the lowest supervision conditions or the simplest operation methods.
