Dairy
GACC registration conditions for overseas manufacturers of imported foods are as follows:
1. The food safety management system of the country/region where the manufacturer is located has passed GACC's equivalence assessment and/or review;
2. The manufacturer was established with approval by the competent authority of the country/region, and the manufacturer is under effective regulation by the competent authority;
3. The manufacturer has an established, effective food safety and sanitation management system and protection system, legally produces and exports food in the country/region, and ensures that foods exported to China comply with relevant Chinese laws, regulations, and national food safety standards;
4. Food exporting to China conforms with relevant inspection and quarantine requirements that have been agreed upon after discussion by the GACC and the competent authorities of the country/region.

GACC Procedure

Confirm the HS code and the applicable access method.

Obtain the account and password officially granted by the supervisor or account re-authentication.

Preparing materials in strict accordance with Registration Requirements and Key Checkpoints of Control and Inspection for Overseas Manufactures of Imported Dairy Products(Pasteurized Milk and Infant Formula not Included), conduct self-assessment, and fill in the registration application form.

Submit an electronic application, fill in the enterprise elements and upload relevant materials as required; if necessary, include but not limited to floor plan of factory and workshop, process flow chart, etc.

The competent authority reviews the summary and forwards the electronic application with other support materials required by GACC.

The GACC office will review whether the materials are complete and in compliance with the legal form, and decide whether to accept it or issue a correction notice to the competent authority.

The expert group evaluates and reviews, including a combination of document review and on-site review or other reasonable review methods, and forms a review report.

Review by the General Administration of Chinese Customs whether it meets the statutory requirements and standards.

GACC approve or disapprove the registration, and feedback the information to the competent authority and Enterprise (enterprise applicants can receive the registration feedback in Cifer system).

The enterprises approved for registration, China Customs will publish them online in due course.
Our assistance includes but is not limited to:
1. Assist in product classification, determine the corresponding registration method and the best implementation plan; confirm the applicable official competent authority approval number, enterprise type, precise customs code and inspection and quarantine code details.
2. Assist enterprises to obtain account numbers and passwords.
3. Assist the enterprise to check the registration elements according to the "Registration Conditions and Control Inspection Points of Overseas Manufacturers Imported Dairy Products (Excluding Pasteurized Milk and Infant Formula Dairy Products)", complete the self-assessment, and provide continuous improvement plans based on the assessment results, so as to meet the key points of registration conditions and the standard of China's national food production and products. Assist in sorting, screening, editing, and translating the required materials, so that the application materials meet the integrity, authenticity and validity.
4. Assist in filling out the "Application form of imported dairy products(pasteurized milk and infant formula not included) for overseas manufacturer", submit an electronic application and upload relevant supporting materials.
5. Follow up the application submitted by the competent authority, the basic status report on animal and plant epidemics, veterinary hygiene, public health, plant protection, pesticide and veterinary drug residues related to the exporting country (region), the registration management of food production enterprises and the requirements of enterprise hygiene standards, etc. The laws, regulations and standards of the exporting country (region), the organization and personnel of the competent authority of the exporting country (region), the quarantine of the exporting country (region) competent authority of its recommended enterprises, the assessment answer sheet of the actual situation of sanitation control, the exporting country (regional) competent authority's assessment of the actual situation. A statement that the companies that are recommends comply with Chinese laws and regulations.
6. Materials correction, when the written materials do not meet the registration requirements, assist the enterprise to complete the interpretation, sorting, screening, editing, translation, calibration and other standards and laws and regulations of the required materials within the specified time.
7. Acceptance by Chinese Customs and follow-up and communication of technical review by expert group, preparation and coordination before on-site review or video review.
8. Assist in successful access and follow up on the use of registration data for customs clearance, and respond immediately if there are any problems.
9. According to the change of the enterprise, assist the change application.
10. According to the new decree, assist enterprises to apply for extension. "Registration application for extension for overseas manufacturers of imported dairy products(pasteurized milk and infant formula not included)"

Answer: GACC has carried out data transfer, and the original data remains unchanged; after the expiration, enterprises must follow the regulations of the General Administration of Customs No. 248 and 249, follow the prescribed materials, prescribed procedures, and submit the extension by overseas CA institutions and conduct technical review and/or Or on-site assessment, according to the new checkpoints, the registration will be renewed, and the original registration number will remain unchanged.
5. What are the inspection and quarantine requirements that remain in effect after the previous inspection and quarantine regulations on imported dairy products are repealed?
(1) Imported dairy products must be accompanied by a health certificate issued by the competent authority of the exporting country or region. The certificate shall have the seal of the competent authority of the exporting country or region and the signature of its authorized person, and the destination shall be marked as the People's Republic of China. (3) Overseas manufacturers should be familiar with and ensure that the dairy products they export to China comply with China's national food safety standards and relevant requirements.
(4) For dairy products imported for the first time, the test report of the items listed in the corresponding national food safety standards shall be provided. Import for the first time refers to the dairy products with identical information such as overseas manufacturers, product names, formulas, overseas exporters, and domestic importers are imported for the first time from the same port.
(5) For dairy products not imported for the first time, a copy of the inspection report of import for the first time and the inspection report of the items required by the General Administration of Customs shall be provided. The items of non-first-time import inspection report shall be determined by the General Administration of Customs based on the dairy risk monitoring and other relevant situations and announced on the website of the General Administration of Customs.
(6) The test report should correspond to the production date or production batch number of the imported dairy products.
(7) The notification and commitment system shall be implemented for imported dairy product testing reports.

4. How to renew the GACC registration after the previous CNCA access of the overseas manufacturer of imported dairy products expires?
Answer: GACC has carried out data transfer, and the original data remains unchanged; after the expiration, enterprises must follow the regulations of the General Administration of Customs No. 248 and 249, follow the prescribed materials, prescribed procedures, and submit the extension by overseas CA institutions and conduct technical review and/or Or on-site assessment, according to the new checkpoints, the registration will be renewed, and the original registration number will remain unchanged.
5. What are the inspection and quarantine requirements that remain in effect after the previous inspection and quarantine regulations on imported dairy products are repealed?
(1) Imported dairy products must be accompanied by a health certificate issued by the competent authority of the exporting country or region. The certificate shall have the seal of the competent authority of the exporting country or region and the signature of its authorized person, and the destination shall be marked as the People's Republic of China. The sample of the health certificate should be confirmed by the General Administration of Customs.
(2) Imported raw milk, raw milk products, pasteurized milk, and modulated milk produced and processed by pasteurization process need to go through entry quarantine approval procedures.
(3) Overseas manufacturers should be familiar with and ensure that the dairy products they export to China comply with China's national food safety standards and relevant requirements.
(4) For dairy products imported for the first time, the test report of the items listed in the corresponding national food safety standards shall be provided. Import for the first time refers to the dairy products with identical information such as overseas manufacturers, product names, formulas, overseas exporters, and domestic importers are imported for the first time from the same port.
(5) For dairy products not imported for the first time, a copy of the inspection report of import for the first time and the inspection report of the items required by the General Administration of Customs shall be provided. The items of non-first-time import inspection report shall be determined by the General Administration of Customs based on the dairy risk monitoring and other relevant situations and announced on the website of the General Administration of Customs.
(6) The test report should correspond to the production date or production batch number of the imported dairy products.

6. Does the formula of imported milk powder under the cross-border e-commerce model need to be registered and whether overseas production enterprises need to be registered with China customs?
Answer: According to (1) the "Notice on Improving the Supervision of Cross-border E-commerce Retail Imports" jointly issued by six ministries including the Ministry of Commerce; (2) "Notice On Improving Cross-border E-commerce Retail Imports tax policy " jointly issued by three ministries including the Ministry of Finance (3) “The Announcement on Adjusting the List of Cross-border E-commerce Retail Imported Commodities” jointly issued by the Ministry of Finance and other 13 ministries and commissions (hereinafter referred to as the “List (2018 Edition)”). The "List (2018 Edition)" involves formula milk powder "19011010" and other retail packaged foods for infants and young children in the tariff code column "19011090", while "19011010 formula milk powder" covers infant formula milk powder, and the previous reference to the formula milk powder is deleted. "Formula milk powder" in the "Food Safety Law, except for infant formula milk powder that should be registered but not registered". Infant formula milk powder imported from the pilot cities specified in the "Notice" can enter the Chinese market through cross-border e-commerce channels, without the need to obtain a product formula registration certificate, and overseas manufacturers do not need to undergo customs registration.
7. What are the kind reminders for the secondary registration of imported milk powder formula?
Answer: Before 2022, these products will need to be registered again. According to the 1-2 year registration process (about 1 to 1.5 years for domestic formulas, about 2 years for foreign formulas), it is suggested that enterprises need to start re-applying again around 2021. The State Administration for Market Supervision will further strengthen the review of the scientificity, materials safety and research and development reports of infant formula milk powder product formulas. If the scientific basis of the formula is insufficient, and the submitted materials do not support the scientificity and safety of the formula, it will not be registered.
8. Do exporters or shippers need to record?

Classification of Imported Dairy Products:
Dairy products include colostrum, raw milk and dairy products.
Colostrum is the milk produced by dairy animals within 7 days of calving.
Raw milk refers to normal milk without any composition changes produced from the udders of healthy dairy animals that meet the relevant requirements of China.
Dairy products refer to foods processed from milk as the main raw material, such as: pasteurized milk, sterilized milk, modified milk, fermented milk, cheese and reprocessed cheese, light cream, cream, anhydrous cream, condensed milk, milk powder (including colostrum powder), whey powder, lactalbumin powder and milk-based infant formula foods (including infant formula food based powder).
Regulatory Measures:

Solutions for Meeting the Requirements of Regulatory Measures:
1. Exporting countries and products shall obtain market access to China;
Solutions: (1) Assessment and review. For countries or regions that export dairy products to China for the first time, their competent government authorities shall provide the GACC with information on systems of laws and regulations of veterinary health and public health, organizational structures, veterinary service systems, safety and health control systems, residue monitoring systems, animal disease detection and monitoring systems and the types of products to be exported to China. (2) Confirmation of inspection and quarantine requirements. The GACC shall organize assessment according to law and, when necessary, may assign an expert team to the said country or region for on-site investigation; After the investigation, an protocol on inspection and quarantine conditions of dairy products exported to China shall be signed between the two sides, so as to confirm the scope of products allowed to be imported, inspection and quarantine contents and health certificates.
2. Overseas manufacturing enterprises shall register with China Customs and obtain the registration number for exporting to China;
Solution: The applicant enterprise shall fill out the application form through the CIFER registration system after the official recommendation, and shall meet the standards and requirements stipulated in the Compliance Checklist for Registration of Overseas Manufacturers of Imported Dairy Products; After the GACC receives the application, the expert panel shall evaluate and examine the applicant through written inspection, video inspection, on-site inspection and other forms of inspection or any combination of the above, and register the overseas manufacturers of imported food that meet the requirements and give them the registration number in China.

Solutions for attaining the information required for Customs declaration (part of information):

Solution: Imported dairy products shall be accompanied by a sanitary certificate issued by the competent government authority of the exporting country or region. The said certificate shall be sealed by the competent government authority of the exporting country or region and signed by its authorized person, and the destination shall be marked as the People's Republic of China. Importers shall log in the "Internet + Customs" integrated online service platform (platform address: http://online.customs.gov.cn) for handling.
3. Nutritional composition test report
Solution: For the first import of dairy products, the test report of the items listed in the national food safety standard should be provided. First import refers to the import of dairy products with the same information of overseas production enterprise, product name, formula, overseas exporter and domestic importer for the first time from the same port. For non-first import of dairy products, a copy of the first import test report and the test report on the items required by the GACC shall be provided. The items of non-first import test report shall be determined by the GACC based on the risk monitoring of dairy products and other relevant conditions and shall be published on the website of the GACC. The test report shall correspond to the production date or batch number of the imported dairy products. The testing institution that issues the test report for imported dairy products can be an overseas official laboratory, a third-party testing institution or a company laboratory, or a domestic testing institution that has obtained the qualification of a food inspection institution.
4. Automatic import license (required for sterilized milk and milk powder, not for others)
Solution: Automatic import license refers to the license certificate issued by a license-issuing organ authorized by the Ministry of Commerce to approve the import of goods subject to automatic import license administration according to law. To obtain an automatic import license, an importer shall apply for corporate record-keeping first and apply for the electronic key on the website of the Ministry of Commerce. With the electronic key, the importer can log on the website of the Ministry of Commerce to handle relevant documents. For sterilized milk and milk powder, an Automatic Import License should be provided. Enterprises are not required to submit their paper automatic import license for inspection during import declaration. After entering the automatic import license number, the electronic license can be checked through online verification of automatic import license, no need for paper endorsement.
Process of importing dairy products
Step 1: Confirm whether the exporting country has been granted access
Log on the website of the GACC to look up the list of dairy products in the "Catalogue of Foods Exported to China from Countries or Regions that Meet the Requirements of Assessment and Examination and Have Traditional Trade" to determine whether the county exporting dairy products have been granted access.
Step 2: Registration of overseas dairy manufacturers
The GACC implements a registration system for overseas food manufacturers exporting dairy products to China. GACC examines the food manufacturers recommended by the competent authorities of the countries or regions exporting dairy products to China to apply for registration. GACC will approve registration if they meet the registration conditions, and announce the registration on the website.
Step 3: Record-keeping for importers and exporters
Log on to the "Internet + Customs" integrated online service platform (http://online.customs.gov.cn) or the "Single Window" of China International Trade (https: //www.singlewindow.cn), and select the option of "Record-keeping for importers and exporters of Imported Food and Cosmetics" to apply for record-keeping.
Step 4: Quarantine approval of imported dairy products
The GACC shall specify the types of imported dairy products that need quarantine approval and announce them on its official website.
So far imported dairy products that need to go through quarantine approval procedures include raw milk, raw dairy products, pasteurized milk, and modified milk produced by pasteurization process. The quarantine approval shall be handled on the "Internet + Customs" integrated online service platform before signing the trade contract.
Step 5: Declaration
Log on to the "Single Window" of China International Trade and select "Goods Declaration" to declare. The application materials are as follows:
1. Contract, invoice, packing list, bill of lading and other necessary documents.
2. Sanitary certificate issued by the competent government authority of the exporting country or region. The manufacturing enterprises on the official sanitary certificate of imported dairy products should be registered enterprises published on the official website of the GACC.
3. For first import of dairy products, a test report of the items listed in the corresponding national food safety standards shall be provided, including the standards for contaminants and mycotoxins in food cited therein.
First import refers to the import of dairy products with the same information of overseas production enterprise, product name, formula, overseas exporter and domestic importer for the first time from the same port.
For non-first import of dairy products, a copy of the test report and Customs declaration form in the first import and the test report on the items required by the GACC shall be provided. The items of non-first import test report shall be determined by the GACC based on the risk monitoring of dairy products and other relevant conditions and shall be published on the website of the GACC. The test report shall correspond to the production date or batch number of the imported dairy products.
4. If the safety and health items of imported dairy products (including pathogenic bacteria, mycotoxins, pollutants, heavy metals and illegal additives) are unqualified, the importer shall provide the test report on the items listed in the corresponding national standard for food safety (including the contaminants and mycotoxins cited therein) for 5 consecutive batches (referring to 5 different production batches or production dates) when importing them again. If the unqualified item is an illegal additive, it shall be included in the test report.
5. For the import of pre-packaged dairy products, the sample of the original label, the Chinese translation of the original label, the sample of the Chinese label and other materials shall be provided.
6. A quarantine permit for imported animals and plants shall be obtained for the import of dairy products subject to quarantine approval.
7. Where health care functions are involved, a license certificate issued by the relevant authority shall be obtained.
8. Where awards, honors, certification marks, etc. are marked on the label, relevant supporting documents confirmed by diplomatic channels shall be provided.
Step 6: Inspection and quarantine
The Customs shall conduct inspection and quarantine on imported dairy products.
Only those that pass the Inspection and Quarantine shall be sold or used after the Customs issues an Inspection & Quarantine Certificate for Entry Goods.
For dairy products fail to pass the inspection and quarantine, the Customs shall issue a certificate of disqualification. Where items related to safety, health and environmental protection are unqualified, the Customs shall order the parties concerned to destroy them, or issue a notification for the return of goods, and the importer shall handle the formalities for the return of goods. Other items that are unqualified may be subject to technical treatment under the supervision of the Customs, and may be sold or consumed only after they pass the re-inspection.
