Regarding the Inspection and Quarantine Requirements for Poria from Congo to China

According to the regulations of the Chinese Customs and the Ministry of Agriculture, Animal Husbandry and Fisheries of the Republic of Congo on the plant quarantine requirements for the export of Congolese Poria to China, from now on, the import of Poria that meets the following requirements is allowed.

 

I. Inspection and quarantine basis

(I) "Biosafety Law of the People's Republic of China";

(II) "Law of the People's Republic of China on Entry and Exit Animal and Plant Quarantine" and its implementing regulations;

(III) "Food Safety Law of the People's Republic of China" and its implementing regulations;

(IV) "Measures for the Supervision and Administration of Entry and Exit Chinese Medicinal Materials Quarantine";

(V) "Protocol on Plant Quarantine Requirements for the Export of Congolese Poria to China between the General Administration of Customs of the People's Republic of China and the Ministry of Agriculture, Animal Husbandry and Fisheries of the Republic of Congo".

 

II. Names of commodities allowed for entry

Poria in this announcement refers to the dried sclerotia of the Polyporaceae fungus Poria (scientific name: Poria cocos; English name: Poria) that grows wild or is cultivated in the Republic of Congo.

 

III. Enterprise registration

Enterprises producing, processing and storing Poria for export to China should be reviewed by the Ministry of Agriculture, Animal Husbandry and Fisheries of the Republic of Congo and approved for registration by the Chinese Customs. The registration information shall include the name, address and registration number so as to accurately trace the source of the exported goods when they do not comply with the relevant provisions of this announcement. Before the start of trade, the Ministry of Agriculture, Livestock and Fisheries of the Congo shall provide the registration list to the Chinese Customs, which shall be published on the customs website after approval.

V. Pre-export management

(I) Production and processing requirements.

1. Under the supervision and guidance of the Ministry of Agriculture, Livestock and Fisheries of the Congo, enterprises exporting Poria to China shall adopt systematic management and comprehensive measures to control pests and diseases, including epidemic monitoring, comprehensive prevention and control, and post-harvest processing, and keep relevant records.

2. Pest monitoring and prevention shall be completed under the guidance of professional technicians, who shall receive training from the Ministry of Agriculture, Livestock and Fisheries of the Congo or its authorized institutions.

3. Once quarantine pests of concern to the Chinese Customs are found during monitoring, enterprises shall take corresponding prevention and control measures in a timely manner to ensure that the Poria exported to China do not carry quarantine pests of concern to the Chinese Customs.

4. Poria exported to China should be cleaned of soil and impurities and dried.

(II) Packaging requirements.

1. Packaging materials should be clean, hygienic and unused, and comply with China's relevant plant quarantine requirements. If wooden packaging is used, it should comply with the requirements of International Standard for Phytosanitary Measures No. 15 (ISPM 15).

2. Each package box should be marked with traceability information such as product name, country, origin (province, city or region), planting base and packaging factory name or its registration number in Chinese or English. Each package box and pallet should be marked with "输往中华人民共和国" or "Exported to the People's Republic of China" in Chinese or English.

3. The means of transport or container loaded with Poria exported to China should be checked for good sanitary conditions during shipment. The means of transport or container should be sealed and the seal should be intact when arriving at the Chinese entry port.

(III) Pre-export inspection and quarantine and certificate requirements.

1. Poria exported to China shall be subject to inspection and quarantine supervision by the Congolese Ministry of Agriculture, Livestock and Fisheries. After confirming that it meets the requirements of this announcement, it is allowed to be exported to China.

2. If quarantine pests, soil or plant residues of concern to the Chinese Customs are found, the entire batch of goods shall not be exported to China. The Ministry of Agriculture, Livestock and Fisheries of the Congo should immediately suspend the export of Poria from the relevant enterprises to China until the reasons are found and effective improvement measures are taken. At the same time, relevant records should be kept and provided to the Chinese Customs upon request.

3. For Poria exported to China that have passed the quarantine, the Ministry of Agriculture, Livestock and Fisheries of the Congo should issue a phytosanitary certificate in accordance with the International Standard for Phytosanitary Measures No. 12 (ISPM 12), indicating the name or registration number of the enterprise. The additional statement on the phytosanitary certificate should state: "This consignment complies with the requirements specified in the Protocol of Phytosanitary Requirements for Export of Poria from Congo to China, and is free from quarantine pests of concern to China."

4. Before the start of trade, the Ministry of Agriculture, Livestock and Fisheries of the Congo should provide a sample of the phytosanitary certificate to the Chinese Customs for confirmation and filing. If the content and format of the certificate sample are changed, the Congolese Ministry of Agriculture, Livestock and Fisheries shall file it with the Chinese Customs at least one month before it takes effect.

 

VI. Entry quarantine and unqualified treatment

When the imported Poria arrives at the entry port, the Chinese Customs will implement quarantine in accordance with the following requirements:

(I) Verification of relevant certificates and labels.

1. Verify whether the plant quarantine certificate complies with the provisions of Article 5, Item (III) of this Announcement.

2. Verify whether the labels on the packaging boxes and pallets comply with the provisions of Article 5, Item (II) of this Announcement.

(II) Entry quarantine.

In accordance with relevant laws, administrative regulations, rules and other regulations, quarantine shall be implemented on imported Poria . If it passes the quarantine, it shall be allowed to enter the country.

(III) Unqualified treatment.

1. If it is found that it comes from an unregistered enterprise, the batch of goods shall not be allowed to enter the country.

2. If it is found that there is no valid plant quarantine certificate attached, the batch of goods shall be returned or destroyed.

3. If quarantine pests or other quarantine pests of concern to China Customs are found, or soil, plant residues, etc. are found, the batch of goods will be returned, destroyed or treated for pests.

4. If other non-compliance is found, it will be handled in accordance with relevant Chinese laws and regulations.

5. If the above non-compliance is found, China Customs will notify the Ministry of Agriculture, Livestock and Fisheries of the Congo and suspend the import of Poria by the relevant enterprises as appropriate. The Ministry of Agriculture, Livestock and Fisheries of the Congo should find out the reasons for the non-compliance and make rectifications to avoid such situations from happening again. Based on the rectification results of the Ministry of Agriculture, Livestock and Fisheries of the Congo, China Customs will decide whether to cancel the suspension measures.
