Regarding the Inspection and Quarantine Requirements for the Wild Aquatic Products of Russia

In accordance with Chinese laws and regulations and the inspection, quarantine and veterinary health requirements of the General Administration of Customs of the People's Republic of China and the Russian Federal Bureau of Veterinary and Phytosanitary Supervision on wild aquatic products exported from Russia to China, from now on, the import of Russian wild aquatic products that meet the following relevant requirements is permitted:

 

I. Basis for inspection and quarantine

 

(1) The Import and Export Animal and Plant Quarantine Law of the People's Republic of China, the Implementation Regulations of the Import and Export Commodity Inspection Law of the People's Republic of China, the Implementation Regulations of the Import and Export Commodity Inspection Law of the People's Republic of China, the Food Safety Law of the People's Republic of China, and the Implementation Regulations of the Food Safety Law of the People's Republic of China;

 

(2) The Measures of the People's Republic of China for the Administration of Import and Export Food Safety and the Provisions of the People's Republic of China for the Registration of Overseas Production Enterprises of Imported Food;

 

(3) Protocol between the General Administration of Customs of the People's Republic of China and the Department of Veterinary and Phytosanitary Supervision of the Russian Federation on Inspection, Quarantine and Veterinary Hygiene Requirements of wild aquatic Products exported from Russia to China (hereinafter referred to as the Protocol).

 

2. Scope of imported products

 

Wild aquatic products refer to wild aquatic living resources for human consumption, namely aquatic animal and plant products such as fish, aquatic invertebrates, aquatic mammals, algae, etc. Species listed in the Appendix of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) on March 3, 1973 and the List of Wildlife under State Key Protection of China, living aquatic animals and aquatic animal breeding materials are not included.

 

3. Requirements of production enterprises

 

Production enterprises exporting wild aquatic products to China (including fishing vessels, processing vessels, transport vessels, processing enterprises, independent cold storage) shall comply with the requirements of the relevant veterinary health and public health regulations of China and Russia, and be approved by the Russian authorities and subject to their effective supervision.

 

According to the Food Safety Law of the People's Republic of China and the Implementation Regulations of the Import and Export Animal and Plant Quarantine Law of the People's Republic of China, the production enterprises that export wild aquatic products to China shall be recommended for registration by the Russian Federal Veterinary and Phytosanitary Supervision Service (hereinafter referred to as Russia) to the General Administration of Customs of the People's Republic of China (hereinafter referred to as China). No export to China without registration.

 

4. Requirements for imported products

 

Russia shall ensure that wild aquatic products exported to China meet the following conditions:

 

(1) Aquatic living resources lawfully harvested in the waters of the Russian Federation, territorial waters, continental shelf, convention areas and the high seas.

 

(b) Raw materials and products are not in the areas covered by the following issues:

 

1. The occurrence in Russia of an aquatic animal disease which is listed in the List of Imported Animal Quarantine Diseases of the People's Republic of China and which is notifiable according to the World Organization for Animal Health (WOAH) and is related to the products of the Protocol, which causes wild aquatic products exported to China to be infected or likely to be infected;

 

2. Any major food safety incident in Russia that has affected or may affect wild aquatic products exported to China;

 

3. Russia has exported or intends to export wild aquatic products to China in serious violation of the laws and regulations of China and Russia and the provisions of the Protocol;

 

4. A major public health event occurs in the production enterprise, such as the infection of employees with major infectious diseases, which has contaminated or may contaminate wild aquatic products exported to China, their packaging and means of transport;

 

5. The fishing area is affected by pollutants, such as radioactive pollutants, which have contaminated or may contaminate wild aquatic products imported into China.

 

(C) does not directly or indirectly use drugs or additives prohibited by both parties; Use drugs or additives that are restricted or permitted in China in accordance with regulations; No pathogenic microorganisms, toxic and harmful substances and foreign bodies listed in Chinese and Russian laws and regulations were found after inspection by the competent authorities.

 

(4) All wild aquatic products exported to China have been found to be hygienic, safe and fit for human consumption after quarantine inspection by the competent authorities of Russia, and no aquatic animal diseases listed in the List of Imported Animal Quarantine Diseases of the People's Republic of China and notifiable as stipulated by the World Organization for Animal Health (WOAH) have been found.

 

(5) The whole process of fishing, processing, packaging, storage, transportation, transit and export shall meet the relevant health requirements and traceability requirements of both sides. At the same time, it meets the relevant safety and health requirements of cold chain food.

 

5. Certificate requirements

 

Each container of wild aquatic products exported from Russia to China shall be accompanied by at least one original veterinary (health) certificate certifying that the products comply with the relevant provisions of the veterinary and public health laws and regulations of China and Russia and the Protocol. Russia shall complete the information of the production enterprises involved in the whole process of fishing, processing, packaging, storage, transportation, transit and export on the veterinary (health) certificate, including the name and registration number of the fishing vessel, processing vessel, transport vessel, processing plant and independent cold storage.

 

The certificate is printed in Chinese, Russian and English (English is required when completing the certificate). The format and content of the certificate shall be approved by both parties in advance. Russia shall promptly provide China with the sample of the certificate, the official seal and the handwriting style of the signatory officer for the record. If there is any change, Russia shall file it with China at least one month before it takes effect.

 

6. Packaging and marking requirements

 

Wild aquatic products exported from Russia to China shall have outer packaging and separate inner packaging (except for further processing). The internal and external packaging should be new materials that meet international health standards and meet the requirements of preventing pollution by external factors.

 

There should be firm, clear and easily distinguishable labels in Chinese and English on the internal and external packaging, including: product name and scientific name, specifications, production date, shelf life, batch number, storage conditions, production method (wild fishing), name and registration number of the production enterprise, production region, address of the production enterprise (specific to the state/province/city), destination (marked as the People's Republic of China).

 

For wild aquatic products exported to China in the form of pre-packaging, the pre-packaged Chinese labels shall comply with the requirements for the labels of imported pre-packaged food in China.

 

7. Other requirements

 

The Chinese Customs shall conduct import inspection and quarantine on wild aquatic products imported into China.

 

Non-conforming products will be returned, destroyed or otherwise disposed of in accordance with Chinese laws and regulations. For production enterprises with serious problems or repeated failures, China will take measures such as strengthening inspection and quarantine or suspending imports.
