Regarding the Inspection and Quarantine Requirements for Aquaculture Products from Thailand to China

According to the regulations of China Customs and the Ministry of Agriculture and Cooperatives of Thailand on the inspection, quarantine and sanitation requirements for farmed aquatic products exported from Thailand to China, starting from now, farmed aquatic products from Thailand that meet the following relevant requirements are allowed to be imported:

 

I. Inspection and quarantine basis

(I) "Food Safety Law of the People's Republic of China" and its implementing regulations, "Law of the People's Republic of China on Entry and Exit Animal and Plant Quarantine" and its implementing regulations, "Import and Export Commodity Inspection Law of the People's Republic of China" and its implementing regulations.

(II) "Administrative Measures for Import and Export Food Safety of the People's Republic of China" and "Registration and Administration Regulations for Overseas Production Enterprises of Imported Food of the People's Republic of China".

(III) "Protocol on Inspection, Quarantine and Sanitation Requirements for Farmed Aquatic Products Exported from Thailand to China between the General Administration of Customs of the People's Republic of China and the Ministry of Agriculture and Cooperatives of Thailand".

 

II. Scope of imported products

Farmed aquatic products refer to aquatic animal products and their products, aquatic plant products and their products that are artificially cultivated for human consumption, excluding species listed in the Appendix of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) or the List of Key Protected Wildlife in China, live aquatic animals and aquatic animal and plant breeding materials.

 

III. Requirements for production enterprises

Production enterprises (including processing enterprises and independent cold storage) and farms that export farmed aquatic products to China should be approved by the Thai authorities and be effectively supervised by them. The sanitary conditions of production enterprises should comply with the requirements of relevant food safety laws and regulations of China and Thailand.

According to the relevant provisions of the Food Safety Law of the People's Republic of China and its implementing regulations, the Law of the People's Republic of China on Entry and Exit Animal and Plant Quarantine and its implementing regulations, and the Measures for the Administration of Import and Export Food Safety of the People's Republic of China, production enterprises that export farmed aquatic products to China should be recommended for registration by the Ministry of Agriculture and Cooperatives of Thailand and the Chinese Customs. Without registration, they are not allowed to export to China.

 

IV. Requirements for imported products

The Ministry of Agriculture and Cooperatives of Thailand should ensure that farmed aquatic products exported to China meet the following conditions:

(i) Farmed in domestic waters;

(ii) The raw materials and products do not have the following problems:

1. Aquatic animal diseases listed in the List of Animal Quarantine Diseases for Entry into the People's Republic of China or required to be reported by the World Organization for Animal Health (WOAH) related to the products of the Protocol occur in Thailand, causing farmed aquatic products exported to China to be or may be infected;

2. Any major food safety incident reported by the World Health Organization (WHO) or WOAH has occurred in Thailand, which has affected or may affect the export of farmed aquatic products to China;

3. The export of farmed aquatic products from Thailand to China seriously violates Chinese laws and regulations and the provisions of the Protocol;

4. According to international standards, the breeding areas are affected by pollutants, such as radioactive pollutants, which have contaminated farmed aquatic products exported to China.

(iii) No drugs or additives banned by Chinese customs are used directly or indirectly (such as in feed), and drugs or additives restricted or permitted by Chinese customs are used in accordance with regulations; after inspection by the competent authorities, no pathogenic microorganisms, toxic and harmful substances and foreign matter listed in Chinese laws and regulations are found.

(iv) All farmed aquatic products exported to China are safe, hygienic and suitable for human consumption after inspection and quarantine by the competent authorities. No pathological signs of infectious diseases and parasitic diseases are found, and no aquatic animal diseases listed in the Disease List and required to be reported by WOAH are found.

(v) The entire process from breeding, processing, packaging, storage, transportation, transit and export should meet the safety and sanitation requirements and traceability requirements of both parties for aquatic products. At the same time, it must comply with the relevant safety and sanitation requirements of the cold chain.

 

V. Certificate requirements

Each batch of farmed aquatic products exported from Thailand to China shall be accompanied by an original health certificate to prove that the batch of products complies with the relevant laws and regulations on food safety in China and Thailand and the relevant provisions of the Protocol. The Ministry of Agriculture and Cooperatives of Thailand shall fully fill in the information of the production enterprises involved in the entire process of breeding, processing, packaging, storage, transportation, transit and export on the health certificate, including the name and registration number of the farm, processing plant and independent cold storage, and shall not omit the information of the production enterprises involved in any of the above links.

The above listed information will be provided in English on the Chinese or English certificate. The format and content of the certificate must be approved by both parties in advance. The Ministry of Agriculture and Cooperatives of Thailand shall promptly provide the certificate sample, the official issuing agency seal and the handwriting of the signing official to the Chinese Customs for filing. If there are changes in the content and format of the certificate sample, the official issuing agency seal and the handwriting of the signing official, the Ministry of Agriculture and Cooperatives of Thailand shall file it with the Chinese Customs at least one month before it takes effect.

 

VI. Other requirements

The Chinese Customs implements entry inspection and quarantine for farmed aquatic products exported to China.

For unqualified products, they will be returned, destroyed or otherwise handled in accordance with Chinese laws and regulations. For manufacturers with serious problems or repeated unqualified problems, Chinese customs will take measures such as strengthening inspection and quarantine or suspending imports.
