Regarding the Inspection and Quarantine Requirements for Phaseolus Vulgaris L.(Kidney Bean) from Poland to China
I. Inspection and quarantine basis
(I) "Biosafety Law of the People's Republic of China";
(II) "Law of the People's Republic of China on Entry and Exit Animal and Plant Quarantine" and its implementing regulations;
(III) "Food Safety Law of the People's Republic of China" and its implementing regulations;
(IV) "Law of the People's Republic of China on Import and Export Commodity Inspection" and its implementing regulations;
(V) "Measures for the Supervision and Administration of Entry and Exit Grain Inspection and Quarantine";
(VI) "Measures for the Administration of Import and Export Food Safety of the People's Republic of China";
(VII) "Protocol on Inspection and Quarantine Requirements for the Export of Polish Kidney Beans to China between the General Administration of Customs of the People's Republic of China and the Ministry of Agriculture and Rural Development of the Republic of Poland".
II. Names of commodities allowed to enter the country
The kidney beans in this announcement refer to the seeds of non-seed kidney beans (Phaseolus vulgaris L.) grown and processed in Poland for direct consumption or food processing.
III. Permitted origin
All regions of Poland.
IV. Enterprise Registration
The beans exported to China should come from production, processing and storage enterprises approved by the Polish National Plant Health and Seed Inspection Bureau. The production, processing and storage enterprises are recommended by the Polish National Plant Health and Seed Inspection Bureau to the Chinese Customs, and are registered after inspection or review by the Chinese Customs, and are published and updated on the Chinese Customs website.
V. Pests of Concern
The beans exported to China shall not carry the following quarantine pests:
1. Apple stem grooving virus
2. Arabis mosaic virus
3. Broad bean stain virus
4. Peanut stunt virus
5. Prunus necrotic ringspot virus
6. Tobacco ringspot virus
7. Tomato black ring virus
8. Tomato ringspot virus
9. Tomato spotted wilt orthotospovirus
10. Acanthoscelides obtectus
11. Zabrotes subfasciatus
12. Pseudomonas savastanoi pv. phaseolicola
13. Ambrosia artemisiifolia
14. Sorghum halepense
15. Phytophthora sojae
VI. Requirements before Shipment
(I) Production requirements.
1. The Polish National Plant Health and Seed Inspection Bureau shall guide bean production enterprises to implement good agricultural practices and establish an integrated pest control system.
2. The Polish National Plant Health and Seed Inspection Bureau shall establish an effective traceability management system to ensure that the beans exported come from places of origin that meet the requirements of the Chinese Customs.
3. The Polish National Plant Health and Seed Inspection Bureau shall supervise enterprises to screen and clean, and effectively remove deformed, broken, diseased grains, plant residues, weed seeds, etc.
(II) Packaging and transportation requirements.
The beans exported to China are transported in packaging, using clean and new materials that meet the requirements of the Chinese Customs. Each package should be marked in English with the words "This product is exported to the People's Republic of China" and the product name, place of origin, name of the manufacturer and processor, and its registration number and address.
The transportation vehicles for kidney beans exported to China should meet the requirements of hygiene and epidemic prevention, and a thorough inspection should be carried out before shipment to prevent the entry of pests.
(III) Product requirements.
Kidney beans exported to China should comply with the laws and regulations on plant quarantine for entry into China and the requirements of national food safety standards. They should not carry quarantine pests of concern to the Chinese customs, soil and other living insects, and other impurities such as weed seeds, plant residues and gravel.
(IV) Pre-export inspection and quarantine and certificate requirements.
Before export, the Polish National Plant Health and Seed Inspection Service should conduct inspection and quarantine on kidney beans exported to China. For goods that meet the requirements, a phytosanitary certificate shall be issued in accordance with the International Standard for Phytosanitary Measures (ISPM) No. 12 "Guidelines for Phytosanitary Certificates", and the additional statement shall state "This consignment meets requirement of the Protocol of phytosanitary requirements applicable to the export of beans (Phaseolus vulgaris L.) from the Republic of Poland to the People's Republic of China and is free of any quarantine pest concerned to the People's Republic of China", and the processing enterprise of the batch of goods and its registration number, exporter information, etc. shall also be noted.
If live insects are found in kidney beans exported to China, effective quarantine treatment shall be carried out before export, and the treatment method, time, temperature, and pesticides shall be indicated in the phytosanitary certificate.
VII. Entry Inspection and Quarantine
When kidney beans exported to China arrive at the Chinese entry port, the Chinese Customs shall implement inspection and quarantine in accordance with the following requirements.
(I) Certificate verification.
1. Verify whether the "Entry Animal and Plant Quarantine Permit" has been obtained.
2. Verify whether it comes from a registered enterprise.
3. Check whether the attached plant quarantine certificate is authentic and valid.
(II) Cargo inspection.
1. According to relevant laws, administrative regulations, rules and regulations, and in combination with the requirements of this announcement, inspection and quarantine shall be carried out on imported kidney beans. If they pass the inspection and quarantine, they shall be allowed to enter the country.
2. Kidney beans shall be inspected and quarantined at the supervision sites designated by the Chinese Customs.
(III) Disqualified treatment.
1. If there is no plant quarantine certificate, they shall be returned or destroyed.
2. If living quarantine pests or other living pests of concern to the Chinese Customs are found, they shall be treated with pest control if there are effective treatment methods; if there are no effective treatment methods, they shall be returned or destroyed.
3. If it is found that it does not meet the national food safety standards of China, it shall be returned or destroyed.
4. If it is found that it contains impurities such as soil, plant residues and gravel, it shall be harmlessly treated, returned or destroyed in accordance with relevant laws and regulations. If the above-mentioned non-conformities are found, China Customs will notify the Polish National Plant Health and Seed Inspection Service and take measures to suspend the export of relevant enterprises depending on the severity of the non-conformities, until the export of Polish beans to China is suspended.
