Regarding the Inspection and Quarantine Requirements for Bertholletia Excelsa from Peru to China
I. Inspection and quarantine basis
(I) "China Food Safety Law" and its implementing regulations;
(II) "China Entry and Exit Animal and Plant Quarantine Law" and its implementing regulations;
(III) "China Import and Export Commodity Inspection Law" and its implementing regulations;
(IV) "China Import and Export Food Safety Management Measures";
(V) "Protocol on Inspection, Quarantine and Health Requirements for the Export of Bertholletia Excelsa to China between China Customs and the Ministry of Agricultural Development and Irrigation of Peru".
II. Products allowed to be imported
Peruvian bertholletia excelsa that is allowed to be imported refers to nuts for human consumption that are made from the ripe fruits of bertholletia excelsa collected from wild trees in Peru, and are processed in Peru through shelling, selection, drying and other processing techniques.
III. Food safety requirements
Peruvian bertholletia excelsa exported to China should comply with China's food safety laws and regulations and national food safety standards.
IV. Plant quarantine requirements
(1) Berholletia excelsa from Peru must not contain the following quarantine pests of concern to the Chinese Customs: Hypothenemus hampei and Callosobruchus maculatus.
(2) Berholletia excelsa from Peru to China must be shelled and dehydrated using thermal processing machinery such as ovens or dryers. It must not contain live insects or other impurities that are intentionally added or mixed. Moldy grains and residual shells must be removed during processing.
V. Requirements for manufacturers
Manufacturers of bertholletia excelsa from Peru to China must ensure that their products comply with China's food safety and plant quarantine laws and regulations and China's national food safety standards. The production, processing and storage units of bertholletia excelsa from Peru to China should be recommended by the Ministry of Agricultural Development and Irrigation of Peru and registered with the Chinese Customs.
VI. Processing requirements
The entire process of raw material collection, production, processing, storage, transportation and export of bertholletia excelsa from Peru to China shall comply with the relevant food safety and plant health requirements of China and Peru to prevent contamination by pathogenic microorganisms or toxic and harmful substances.
VII. Packaging and labeling requirements
The bertholletia excelsa from Peru to China should be packaged with clean, sanitary, breathable, new materials that meet food safety and plant quarantine requirements, and prevent leakage during transportation. Each package should be marked with "This product is exported to the People's Republic of China", as well as the name, origin, production and processing enterprise of bertholletia excelsa and its registration number in China, name and address of the exporter and other traceable information in Chinese or English.
VIII. Transportation requirements
Before shipping bertholletia excelsa from Peru to China, the Ministry of Agricultural Development and Irrigation of Peru should inspect the means of transport. The means of transport should meet the requirements of sanitary and epidemic prevention, and shall not be mixed with quarantine pests or other restricted quarantine items, such as weed seeds, live insects, plant residues, soil and other foreign impurities.
IX. Certificate requirements
After official inspection and quarantine, the Ministry of Agricultural Development and Irrigation of Peru shall issue a phytosanitary certificate for bertholletia excelsa approved for export to China. The additional declaration column of the phytosanitary certificate shall indicate the name of the bertholletia excelsa production and processing enterprise, its registration number in China, and "The bertholletia excelsa certified by this phytosanitary certificate complies with the provisions of the protocol signed by China and Peru on the inspection, quarantine and health requirements for the export of bertholletia excelsa from Peru to China. This batch of goods does not contain quarantine pests of concern to the Chinese Customs, such as Hypothenemus hampei and Callosobruchus maculatus."
X. Other requirements
The bertholletia excelsa exported from Peru to China should come from enterprises registered with the Chinese Customs. The list of registered Peruvian bertholletia excelsa enterprises exporting to China can be found on the website of the Chinese Customs.
