Regarding the Inspection and Quarantine Requirements for the wild aquatic products from Venezuela

In accordance with Chinese laws and regulations and the inspection, quarantine and hygiene requirements of the General Administration of Customs of the People's Republic of China (hereinafter referred to as China) and the Ministry of Fisheries and Fisheries of the People's Power of the Bolivarian Republic of Venezuela (hereinafter referred to as Venezuela) on wild aquatic products exported from Venezuela to China, the import of wild aquatic products from Venezuela that meet the following relevant requirements is permitted from now on:

 

1. Basis for inspection and quarantine

(1) The Import and Export Animal and Plant Quarantine Law of the People's Republic of China, the Implementation Regulations of the Import and Export Commodity Inspection Law of the People's Republic of China, the Implementation Regulations of the Import and Export Commodity Inspection Law of the People's Republic of China, the Food Safety Law of the People's Republic of China, and the Implementation Regulations of the Food Safety Law of the People's Republic of China;

(2) The Measures of the People's Republic of China for the Administration of Import and Export Food Safety and the Provisions of the People's Republic of China for the Registration of Overseas Production Enterprises of Imported Food;

(3) Protocol between the General Administration of Customs of the People's Republic of China and the Ministry of Fisheries and Fisheries of the People's Power of the Bolivarian Republic of Venezuela on Inspection, Quarantine and Hygiene Requirements of Wild aquatic Products exported from Venezuela to China (hereinafter referred to as the Protocol).

 

2. Scope of imported products

Wild aquatic products refer to wild aquatic animal products and their products, algae and other Marine plant products and their products for human consumption, excluding species listed in the Appendix of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) and the List of Wildlife under Key State Protection of China (LSKPWA), living aquatic animals and aquatic animal and plant reproduction materials.

 

3. Requirements of production enterprises

Production enterprises exporting wild aquatic products to China (including fishing vessels, processing vessels, transport vessels, independent cold storage) shall be approved by the Venezuelan authorities and subject to their effective supervision. The food safety and hygiene conditions of the production enterprises shall comply with the requirements of the relevant food safety laws and regulations of China and Venezuela.

According to the relevant provisions of the Food Safety Law of the People's Republic of China and its implementing regulations, the Import and Export Animal and Plant Quarantine Law of the People's Republic of China and its implementing regulations, the production enterprises that export wild aquatic products to China shall be recommended by Venezuela to register with China. No export to China without registration.

 

4. Requirements for imported products

Venezuela shall ensure that wild aquatic products exported to China meet the following conditions:

4.1 Legally harvested in Venezuelan or international waters.

4.2 Raw materials and products have not occurred the following problems:

4.2.1 The occurrence in Venezuela of an aquatic animal disease which is listed in the List of Imported Animal Quarantine Diseases of the People's Republic of China and which is notifiable according to the World Organization for Animal Health (WOAH) and is related to the products of the Protocol, which causes wild aquatic products exported to China to be infected or likely to be infected;

4.2.2. Any major food safety incident in Venezuela that has affected or may affect wild aquatic products exported to China;

4.2.3. Venezuela has exported or intends to export wild aquatic products to China in serious violation of the laws and regulations of China and Venezuela and the provisions of the Protocol;

4.2.4. Any major public health event occurs in the production enterprise, such as the infection of employees with major infectious diseases, which has contaminated or may contaminate wild aquatic products exported to China, their packaging and means of transport;

4.2.5. The fishing area is affected by pollutants, such as radioactive pollutants, which have contaminated or may contaminate wild aquatic products imported into China.

4.3 does not directly or indirectly use drugs or additives prohibited by both parties, according to the provisions of the use of drugs or additives restricted or permitted by both parties; After examination by the competent authorities of Venezuela, pathogenic microorganisms, toxic and harmful substances and foreign bodies listed in the laws and regulations of China and Venezuela were not found.

4.4 All wild aquatic products exported to China are safe, hygienic and fit for human consumption after inspection and quarantine by the competent authorities of Venezuela, and no pathological indications of infectious and parasitic diseases have been found, and no aquatic animal diseases listed in the List of Diseases for Quarantine Inspection of Imported Animals of the People's Republic of China and notifiable as stipulated by WOAH have been found.

4.5 The whole process of fishing, production and processing, packaging, storage, transportation, transit and export meets the safety and health requirements and traceability requirements of the relevant aquatic products of both sides, and meets the relevant safety and health requirements of the cold chain.

 

5. Certificate requirements

Each batch or container of wild aquatic products exported by Venezuela to China shall be accompanied by at least one original health certificate certifying that the products comply with the relevant laws and regulations of China and Venezuela on food safety and the relevant provisions of the Protocol. Venezuela should complete the information of the production enterprises involved in the whole process of fishing, production and processing, packaging, storage, transportation, transit and export on the health certificate.

The certificate must be printed in at least Chinese and English (English is required when completing the certificate). The format and content of the certificate shall be approved by both parties in advance. Venezuela shall promptly provide the sample certificate, the seal of the official issuing authority and the handwriting of the signatory officer to China for the record. If there is a change in the content and format of the sample certificate, the seal of the official issuing body and the handwriting of the signing officer, Venezuela shall file with China at least one month before the entry into force.

 

6. Packaging and marking requirements

Wild aquatic products exported from Venezuela to China shall have outer packaging and separate inner packaging. The internal and external packaging should be new materials that meet international food safety standards and meet the requirements of preventing contamination by external factors.

The internal and external packaging shall have firm, clear and legible marks in both Chinese and English or Chinese and Western languages, indicating the following: Product name and scientific name, specifications, production date, batch number, warranty period and storage conditions, production method (seawater fishing, freshwater fishing), production region (Marine fishing area, freshwater fishing country or region), all production enterprises involved (including fishing vessels, processing vessels, transport vessels, independent cold storage) name, registration number and address (specific to the state/province/city), destination ( Must be marked as People's Republic of China).

For wild aquatic products exported to China in the form of pre-packaging, the pre-packaged Chinese labels shall comply with the requirements for the labels of imported pre-packaged food in China.

 

7. Other requirements

The Chinese Customs shall conduct inspection and quarantine on imported wild aquatic products.

For non-conforming products, they will be returned, destroyed or otherwise disposed of in accordance with Chinese laws and regulations. China will take measures such as strengthening inspection and quarantine or suspending imports of production enterprises with serious problems or repeated failures.
