Regarding the Inspection and Quarantine Requirements for Export of Fertilizer of Animal Protein from Spain

In accordance with the regulations established by China Customs and the Spanish Ministry of Agriculture, Fisheries and Food regarding the quarantine and sanitary requirements for the export of Spanish animal protein fertilizers to China, effective immediately, the importation of products meeting the following requirements is permitted:

I. Basis for Inspection and Quarantine

(1) *Biosecurity Law of the People's Republic of China*;

(2) *Law of the People's Republic of China on the Entry and Exit Animal and Plant Quarantine* and its Implementing Regulations;

(3) *Measures for the Supervision and Administration of Inspection and Quarantine of Non-edible Animal Products for Entry and Exit*;

(4) *Protocol between the General Administration of Customs of the People's Republic of China and the Ministry of Agriculture, Fisheries and Food of the Kingdom of Spain on Quarantine and Sanitary Requirements for the Export of Animal Protein Fertilizers from Spain to China* (hereinafter referred to as the "Protocol").

II. Scope of Permitted Import Products

Animal protein fertilizers refer to fertilizers derived from the blood of healthy live pigs, collected after slaughter and subsequently processed.

III. Raw Material Requirements

(1) Raw materials shall not be derived from ruminants, and effective measures shall be implemented to prevent contamination by ruminant-derived components;

(2) Animals used for the production of raw materials shall originate from zones free of Foot and Mouth Disease (FMD), Classical Swine Fever (CSF), Swine Vesicular Disease (SVD), and other infectious swine diseases reportable under the regulations of the World Organisation for Animal Health (WOAH); such disease-free zones shall comply with WOAH standards and be recognized by China Customs;

(3) Animals used for the production of raw materials shall be born and raised in Spain, or legally imported from other Member States of the European Union; they shall be slaughtered in slaughterhouses approved by the Spanish Ministry of Agriculture, Fisheries and Food, and shall have undergone ante-mortem and post-mortem inspections without exhibiting any clinical symptoms of infectious animal diseases;

(4) Animals used for the production of raw materials shall not originate from areas subject to transport restrictions, nor shall they be animals that were culled due to outbreaks of animal diseases or death from unknown causes;

(5) Regarding African Swine Fever (ASF): if the raw materials are derived from swine raised in Spain, they shall comply with the relevant requirements of the regionalization agreement on ASF signed between China and Spain;

(6) No blood from other animal species shall be used.

IV. Requirements for Production Enterprises

(1) Comply with the relevant sanitary and veterinary regulations regarding animal-derived fertilizers in both China and Spain;

(2) Be approved by the Spanish Ministry of Agriculture, Fisheries and Food, and operate under its effective supervision; the products produced shall be permitted for free sale within the Spanish market;

(3) Have established and implemented a Hazard Analysis and Critical Control Points (HACCP) quality management system, and have formulated and effectively implemented a product traceability and recall system;

(4) Be recommended to China Customs by the Spanish Ministry of Agriculture, Fisheries and Food, and obtain registration with China Customs; the validity period of such registration shall be five years.

V. Production and Processing Requirements

(1) The product must undergo thermal processing at a core temperature of no less than 160ºC, maintained for a minimum of 4 hours, or utilize other equivalent processing methods approved by China Customs;

(2) The product shall not contain toxic or harmful substances detrimental to animal and plant health, nor ingredients prohibited under the laws and regulations of both parties; furthermore, the content of toxic and harmful substances in the fertilizer must comply with China’s *Limit Requirements of Toxic and Harmful Substances in Fertilizers* (GB 38400);

(3) The product is restricted solely to fertilizer use;

(4) Prior to export to China, the product must undergo official sampling and testing in Spain to ensure compliance with the following requirements:

1. *Salmonella*: Not detected in 25 grams of product: n=5, c=0, m=0, M=0;

2. Enterobacteriaceae: Not exceeding 100 per 1 gram of sample: n=5, c=5, m=0, M=1000;

n — The number of samples tested;

m — The threshold for the bacterial count; if the bacterial count in all samples does not exceed m, the result is deemed satisfactory;

M — The maximum limit for the bacterial count; if the bacterial count in one or more samples equals or exceeds M, the result is deemed unsatisfactory;

c — The number of samples in which the bacterial count falls between m and M; provided that the bacterial count in the remaining samples is less than or equal to m, the result is still considered acceptable.

VI. Packaging, Labeling, and Storage & Transport Requirements

(1) Packaging must utilize brand-new, clean, sealed, and durable packaging materials that possess excellent moisture-proof properties and are resistant to breakage.

(2) The outer packaging must bear a Chinese-language label. This label shall comply with the relevant requirements stipulated in China’s *Fertilizer Labeling: Content and Requirements* (GB 18382).

(3) The outer packaging must clearly indicate the name of the Spanish manufacturing enterprise and the approval number issued by the Spanish Ministry of Agriculture, Fisheries and Food; furthermore, it must be clearly marked with the code "仅限肥料用途".

(4) Effective measures shall be implemented throughout the production, packaging, storage, and transport processes of the animal protein fertilizers to prevent contamination.

VII. Pre-Export Inspection and Certification Requirements

The Spanish Ministry of Agriculture, Fisheries and Food shall be responsible for conducting inspection and quarantine procedures on animal protein fertilizers destined for export to China, and shall issue a Sanitary Certificate attesting that the products comply with the requirements set forth in the *Protocol*.

VIII. Entry Inspection and Quarantine Requirements

(1) Verification of Certificates and Documents:

1. Verify whether an *Entry Quarantine Permit for Animals and Plants* has been obtained.

2. Verify whether the shipment originates from a registered and approved enterprise.

3. Verify the authenticity and validity of the Sanitary Certificate.

(2) Cargo Inspection:

In accordance with relevant laws, administrative regulations, departmental rules, and other applicable provisions—and in conjunction with the requirements set forth in this Announcement—China Customs shall conduct quarantine inspections on animal protein fertilizers imported from Spain. Shipments that pass the quarantine inspection shall be permitted to enter the country.

(3) Handling of Non-Compliant Shipments:

Should any non-compliance be detected during the entry quarantine inspection, China Customs shall take appropriate measures for disposal in accordance with relevant laws, administrative regulations, departmental rules, the *Protocol*, and other applicable provisions.
