Regarding the Inspection and Quarantine Requirements for Export of Wheat Flour from Ukraine

In accordance with the regulations established by China Customs and the State Service of Ukraine on Food Safety and Consumer Protection regarding the inspection, quarantine, and sanitary requirements for wheat flour exported to China, effective immediately, the importation of Ukrainian wheat flour that meets the following relevant requirements is permitted.

I. Basis for Inspection and Quarantine

(1) The *Food Safety Law of the People's Republic of China* and its Implementing Regulations; the *Law of the People's Republic of China on the Entry and Exit Animal and Plant Quarantine* and its Implementing Regulations; and the *Law of the People's Republic of China on Import and Export Commodity Inspection* and its Implementing Regulations;

(2) The *Administrative Measures of the People's Republic of China for the Safety of Import and Export Food* and the *Administrative Provisions of the People's Republic of China on Registration of Overseas Manufacturers of Imported Food*;

(3) The *Protocol between the General Administration of Customs of the People's Republic of China and the State Service of Ukraine on Food Safety and Consumer Protection regarding Inspection, Quarantine, and Sanitary Requirements for Ukrainian Wheat Flour Exported to China* (hereinafter referred to as "the Protocol").

II. Permitted Import Products

Wheat flour refers to a fine powdery product intended for human consumption, obtained by processing wheat (*Triticum aestivum* L.)—grown within the territory of Ukraine—as raw material within the territory of Ukraine.

The State Service of Ukraine on Food Safety and Consumer Protection shall ensure that wheat flour exported to China is free from the dwarf bunt pathogen (*Tilletia controversa* J.G. Kühn), free from live insects, and free from other impurities that have been intentionally added or commingled. The entire process of Ukrainian wheat flour exported to China—from the cultivation of raw materials, production, processing, storage, and transportation to export—shall comply with the relevant safety and sanitary requirements of both China and Ukraine, so as to prevent contamination by pathogenic microorganisms or toxic and harmful substances.

III. Requirements for Production Enterprises

Enterprises in Ukraine engaged in the production, processing, and storage of wheat flour intended for export to China shall ensure that their wheat flour complies with China's laws and regulations regarding food safety and plant quarantine, as well as China's National Food Safety Standards. Furthermore, these enterprises must undergo inspection by the State Service of Ukraine on Food Safety and Consumer Protection to verify compliance with the requirements of China Customs, and must be registered with China Customs.

IV. Raw Material Requirements

(1) The State Service of Ukraine on Food Safety and Consumer Protection shall ensure that the raw materials for wheat flour originate from wheat-growing enterprises that have been verified by Ukraine as complying with China’s food safety and phytosanitary laws and regulations, national food safety standards, and the provisions of this *Protocol*, and which have been duly registered.

(2) The State Service of Ukraine on Food Safety and Consumer Protection shall conduct monitoring for *Tilletia controversa* J.G. Kühn (Dwarf Bunt of Wheat) in wheat-producing regions, in accordance with the requirements of International Standards for Phytosanitary Measures (ISPM) No. 6, "Surveillance," and other internationally recognized methodologies. Should *Tilletia controversa* be detected, the Service shall immediately notify China Customs and suspend the export to China of wheat flour produced using wheat from the affected regions.

V. Packaging Requirements

The State Service of Ukraine on Food Safety and Consumer Protection shall ensure that wheat flour intended for export to China is packaged using new, clean, sanitary, and breathable materials that comply with food safety and phytosanitary requirements, and that the packaging prevents leakage or spillage during transport. Each package shall be marked with the code "本产品输往中华人民共和国" as well as traceability information—provided in either Chinese or English—including the product name, place of origin, name of the production enterprise and its registration number in China, and the name and address of the exporter. The aforementioned information may be affixed to the packaging in the form of a label.

VI. Transport Vehicle Inspection Requirements

Prior to shipment, the State Service of Ukraine on Food Safety and Consumer Protection shall inspect the transport vehicles used for shipping wheat flour to China. These transport vehicles must comply with the sanitary and epidemic prevention requirements of both parties and must be free from any quarantine pests or other restricted quarantine items—such as weed seeds, live insects, impurities from other grains, plant residues, soil, or other extraneous matter.

VII. Certification Requirements

Prior to export, the State Service of Ukraine on Food Safety and Consumer Protection shall issue a Phytosanitary Certificate for wheat flour intended for export to China that has undergone inspection and been verified as complying with the requirements of this *Protocol*. The "Additional Declaration" section of the certificate shall specify the name of the wheat flour production and processing enterprise, its registration number in China, and the code "The wheat flour covered by this phytosanitary certificate complies with the provisions of the Protocol on Inspection, Quarantine and Sanitary Requirements for the Export of Ukrainian Wheat Flour to the People's Republic of China, signed by the General Administration of Customs of the People's Republic of China and the State Service of Ukraine for Food Safety and Consumer Protection. The consignment is free from Tilletia controversa J.G. Kühn."

The content and format of the phytosanitary certificate shall be confirmed by both parties in advance.

To ensure the safety of wheat flour exported to China, the State Service of Ukraine on Food Safety and Consumer Protection shall issue a Certificate for Food of Non-Animal Origin for each consignment of wheat flour exported to China.

VIII. Other Requirements

(1) Upon the arrival of wheat flour exported from Ukraine at a Chinese port of entry, China Customs shall conduct inspection and quarantine supervision; consignments meeting the requirements shall be permitted entry.

(2) If wheat flour exported from Ukraine is found to be in violation of relevant Chinese laws and regulations regarding food safety and phytosanitary measures, national food safety standards, or the provisions of this *Protocol*, China Customs shall take appropriate measures in accordance with relevant Chinese laws and regulations.
