Regarding the Inspection and Quarantine Requirements for the Plant-derived Medicinal Materials from Myanmar

According to the regulations of the Chinese Customs and the Ministry of Agriculture, Livestock and Irrigation of Myanmar concerning phytosanitary requirements for the import of plant-derived Chinese medicinal materials from Myanmar, effective immediately, the import of plant-derived Chinese medicinal materials from Myanmar that meet the following requirements is permitted.

I. Quarantine Basis

(1) The Biosecurity Law of the People's Republic of China;

(2) The Law of the People's Republic of China on Entry and Exit Animal and Plant Quarantine and its implementing regulations;

(3) The Measures for the Supervision and Administration of Quarantine of Imported and Exported Chinese Medicinal Materials;

(4) The Protocol between the General Administration of Customs of the People's Republic of China and the Ministry of Agriculture, Livestock and Irrigation of the Republic of the Union of Myanmar on Phytosanitary Requirements for the Import of Plant-Derived Chinese Medicinal Materials from Myanmar.

II. Permitted Import Commodity Names

Plant-derived Chinese medicinal materials refer to products made from 58 kinds of medicinal plants, including safflower, that are wild or cultivated in Myanmar.

III. Enterprise Registration

Enterprises engaged in the production, processing, and storage of Chinese medicinal materials for export to China must be reviewed by the Ministry of Agriculture, Livestock and Irrigation of Myanmar and registered with the Chinese Customs. Registration information includes name, address, and registration number to facilitate accurate traceability in cases where exported goods do not comply with the relevant provisions of this announcement. Before trade commences, the Myanmar Ministry of Agriculture, Livestock and Irrigation shall provide the registered list to Chinese Customs, which will be published on its official website after review and approval by Chinese Customs.

IV. List of Quarantine Pests of Concern to Chinese Customs

The Myanmar Ministry of Agriculture, Livestock and Irrigation shall ensure that medicinal herbs exported to China do not carry quarantine pests of concern to Chinese Customs. The list of quarantine pests is detailed in the appendix.

V. Pre-Export Management

(I) Integrated Pest Management.

1. Medicinal herbs exported to China shall be subject to integrated pest management measures under the supervision and guidance of the Myanmar Ministry of Agriculture, Livestock and Irrigation, including epidemic monitoring, integrated pest management, and post-harvest treatment, and relevant records shall be maintained.

2. Pest monitoring and control shall be conducted under the guidance of professional technicians from the Myanmar Ministry of Agriculture, Livestock and Irrigation, who shall be trained by the Myanmar Ministry of Agriculture, Livestock and Irrigation or its authorized agencies.

3. If any quarantine pests of concern to Chinese Customs are detected during monitoring, enterprises must promptly take corresponding prevention and control measures to ensure that the Chinese medicinal materials exported to China do not carry these pests.

(II) Processing and Packaging Requirements

1. Chinese medicinal materials exported to China should be free of soil and impurities and dried.

2. Packaging materials should be clean, hygienic, unused, and comply with relevant Chinese phytosanitary requirements. If wooden packaging is used, it must comply with International Standard for Phytosanitary Measures No. 15 (ISPM 15).

3. Each box/bag should be labeled in Chinese or English with the product name, country, place of origin (province, city, or region), enterprise name, and registration number, etc., for traceability. Each box/bag and pallet should be labeled with "输往中华人民共和国" or "Exported to the People's Republic of China" in Chinese or English.

4. Transport vehicles or containers must be inspected for good sanitary conditions at the time of loading. Means of transport or containers shall be sealed, and the seals shall be intact upon arrival at Chinese ports of entry.

(III) Pre-export Inspection and Quarantine.

The Ministry of Agriculture, Livestock and Irrigation of Myanmar shall conduct inspection and quarantine supervision of Chinese medicinal materials exported to China. Export to China is permitted only after confirmation that the materials meet the requirements of this announcement.

If quarantine pests, soil, or plant residues of concern to Chinese Customs are found, the entire shipment shall not be exported to China. The Ministry of Agriculture, Livestock and Irrigation of Myanmar shall immediately suspend the export of Chinese medicinal materials to China by the relevant enterprises until the cause is identified and effective corrective measures are taken. At the same time, relevant records shall be preserved and provided to Chinese Customs upon request.

(IV) Phytosanitary Certificate Requirements.

For Chinese medicinal materials exported to China that have passed quarantine, the Ministry of Agriculture, Livestock and Irrigation of Myanmar shall issue a phytosanitary certificate in accordance with International Standard for Phytosanitary Measures No. 12 (ISPM 12), indicating the enterprise name or registration number and other information. The supplementary declaration on the phytosanitary certificate should indicate "This consignment complies with the requirements specified in the Protocol of Phytosanitary Requirements for Export of Plant-derived Medicinal Materials from Myanmar to China, and is free from quarantine pests of concern to China.".

VI. Import Quarantine and Handling of Non-compliant Materials

When Chinese medicinal materials imported into China arrive at the port of entry, Chinese Customs will verify the relevant documents and markings and implement inspection and quarantine.

(I) Verification of Relevant Certificates and Markings

1. Verify whether the phytosanitary certificate complies with the provisions of Article 5, Paragraph (IV) of this Announcement.

2. Verify whether the markings on the packaging boxes/bags and pallets comply with the provisions of Article 5, Paragraph (II) of this Announcement.

(II) Import Quarantine

1. Chinese medicinal materials imported into China should enter through ports of entry permitted by Chinese Customs for the import of Chinese medicinal materials.

2. Inspection and quarantine shall be carried out in accordance with Chinese laws and regulations, national standards, and the requirements of this Announcement. Those that pass the inspection and quarantine shall be permitted entry.

(III) Handling of Non-compliant Materials

1. If the goods are found to originate from an unregistered enterprise or lack a valid phytosanitary certificate, the goods will be returned or destroyed.

2. If live quarantine pests or other quarantine pests of concern to Chinese Customs are found, or if soil or plant residues are found, the goods will be returned, destroyed, or treated for pest control.

3. If other circumstances are found that do not comply with relevant Chinese laws and regulations, they will be handled in accordance with the relevant regulations.
