Regarding the Inspection and Quarantine Requirements for Export of Pistachios and Dried Figs from Spain
In accordance with the regulations established by China Customs and the Spanish Ministry of Agriculture, Fisheries and Food regarding the inspection, quarantine, and sanitary requirements for pistachios and dried figs exported to China, the importation of Spanish pistachios and dried figs that meet the following requirements is hereby permitted, effective immediately.
I. Basis for Inspection and Quarantine
(1) The *Food Safety Law of the People's Republic of China* and its Implementing Regulations; the *Law of the People's Republic of China on the Entry and Exit Animal and Plant Quarantine* and its Implementing Regulations; and the *Law of the People's Republic of China on Import and Export Commodity Inspection* and its Implementing Regulations;
(2) The *Administrative Measures of the People's Republic of China for the Safety of Import and Export Food* and the *Administrative Provisions of the People's Republic of China on Registration of Overseas Manufacturers of Imported Food*;
(3) The *Protocol between the General Administration of Customs of the People's Republic of China and the Ministry of Agriculture, Fisheries and Food of the Kingdom of Spain on Inspection, Quarantine, and Sanitary Requirements for Spanish Pistachios and Dried Figs Exported to China*.
II. Permitted Import Products
The Spanish pistachios permitted for import refer to pistachios intended for human consumption—either in-shell or shelled—that are produced using pistachios grown within Spain as raw materials, and that have undergone processing procedures within Spain such as sorting, hulling, and drying, provided they have not been roasted or cooked.
The Spanish dried figs permitted for import refer to dried figs intended for human consumption that are produced using figs grown within Spain as raw materials, and that have undergone processing procedures within Spain such as fumigation, washing, blanching, drying, ultraviolet sterilization, and sorting.
III. Food Safety Requirements
Pistachios and dried figs exported to China shall comply with relevant Chinese laws and regulations regarding food safety and plant quarantine, national food safety standards, and the provisions set forth in the *Protocol*.
IV. Plant Quarantine Requirements
(1) Pistachios exported to China shall be free from the following quarantine pests of concern to China Customs:Ectomyelois ceratoniae(Zeller), Trogoderma inclusum LeConte, Trogoderma variabile Ballion, Trogoderma versicolor (Creutzer).
(2) Dried figs exported to China must not be infested with the following quarantine pests of concern to China Customs: Ceratitis capitata Wiedemann, Cydia pomonella (L.), Sowbane masaic virus(SoMV), Ectomyelois ceratoniae(Zeller), Trogoderma versicolor(Creutzer).
(3) Pistachios and dried figs exported to China must be free from live insects, insect eggs, and soil; furthermore, they must not be commingled with impurities such as weed seeds, plant debris, metallic foreign objects, or grit.
(4) Pistachios and dried figs exported to China shall undergo fumigation treatment prior to export to ensure that they are free from live insects.
V. Requirements for Production Enterprises
The Ministry of Agriculture, Fisheries and Food of Spain shall inspect the production, processing, and storage facilities for pistachios and dried figs intended for export to China, in accordance with China Customs’ relevant requirements for the registration of overseas production enterprises for imported food. Enterprises that meet the requirements shall be recommended to China Customs for registration. China Customs shall register those enterprises that satisfy the requirements. Products from an enterprise may be exported to China only after the enterprise has obtained registration in China. The list of registered Spanish enterprises authorized to export pistachios and dried figs to China is available for consultation on the China Customs website.
VI. Requirements for Raw Materials
The raw materials for pistachios and dried figs exported to China shall originate from pistachio and fig cultivation and production enterprises that have been confirmed by the Ministry of Agriculture, Fisheries and Food of Spain as meeting relevant phytosanitary and food safety requirements.
VII. Requirements for Processing Procedures
The Ministry of Agriculture, Fisheries and Food of Spain shall provide guidance on and supervise the entire process—including the cultivation of raw materials, production, processing, storage, transportation, and export—of pistachios and dried figs intended for China. This supervision aims to ensure compliance with the relevant food safety and phytosanitary requirements of both China and Spain, and to prevent contamination by pathogenic microorganisms or toxic and harmful substances.
VIII. Requirements for Packaging and Labeling
Pistachios and dried figs exported to China shall be packaged using clean, sanitary, breathable, and new materials that comply with food safety and phytosanitary requirements, and the packaging must be designed to prevent spillage during transportation. Each package shall be marked in Chinese or English with "本产品输往中华人民共和国/This product is exported to the People's Republic of China" as well as traceability information including the product name, origin, name of the production and processing enterprise and its registration number in China, and the name and address of the exporter. The aforementioned information may be affixed to the packaging in the form of a label.
IX. Transport Requirements
Prior to shipment, the Ministry of Agriculture, Fisheries and Food of Spain shall inspect the means of transport intended for pistachios and dried figs destined for China. The means of transport shall comply with sanitary requirements and shall be free from quarantine pests or other restricted quarantine materials, such as weed seeds, live insects, plant debris, soil, and other impurities.
X. Certification Requirements
Prior to export, the Ministry of Agriculture, Fisheries and Food of Spain shall issue a Phytosanitary Certificate for pistachios and dried figs destined for China that have been inspected and quarantined in accordance with the requirements of the *Protocol*.
The "Additional Declaration" section of the Phytosanitary Certificate for pistachios destined for China shall specify the name of the pistachio production and processing enterprise, its registration number in China, and "The batch of pistachios certified by this phytosanitary certificate complies with the provisions of the Protocol on Inspection, Quarantine and Sanitary Requirements for the Export of Pistachios and Dried Figs from the Kingdom of Spain to the People's Republic of China Between the General Administration of Customs of the People's Republic of China and the Ministry of Agriculture, Fisheries and Food of the Kingdom of Spain signed on April 14th, 2026, by Spain and China. The consignment is free from Ectomyelois ceratoniae (Zeller), Trogoderma inclusum LeConte, Trogoderma variabile Ballion, and Trogoderma versicolor (Creutzer), and other quarantine pests of concern to the Chinese side."
The "Additional Declaration" section of the phytosanitary certificate for dried figs exported to China shall specify the name of the dried fig production and processing enterprise, its registration number in China, and the code "The batch of dried figs certified by the phytosanitary certificate complies with the provisions of the Protocol on Inspection, Quarantine and Sanitary Requirements for the Export of Pistachios and Dried Figs from the Kingdom of Spain to the People's Republic of China Between the General Administration of Customs of the People's Republic of China and the Ministry of Agriculture, Fisheries and Food of the Kingdom of Spain signed on April 14th, 2026, by Spain and China. The consignment is free from Ceratitis capitata Wiedemann, Cydia pomonella (L.), Sowbane masaic virus(SoMV), Ectomyelois ceratoniae (Zeller), and Trogoderma versicolor (Creutzer), and other quarantine pests of concern to the Chinese side."
The quarantine treatment method (e.g., chemical agents, temperature, duration, and other technical requirements) shall be specified in the phytosanitary certificate.
XI. Entry Inspection, Quarantine, and Handling of Non-Compliant Goods
(1) Upon the arrival of pistachios and dried figs exported to China at a Chinese port of entry, Chinese Customs shall conduct inspection and quarantine supervision; consignments found to be compliant shall be permitted to enter the country.
(2) Should pistachios or dried figs exported to China be found to be in violation of relevant Chinese laws and regulations regarding food safety and phytosanitary measures, national food safety standards, or the provisions of the *Protocol*, Chinese Customs shall dispose of such goods in accordance with relevant Chinese laws and regulations.
