Regarding the Inspection and Quarantine Requirements for Phaseolus Vulgaris from Kyrgyzstan to China

According to the provisions of the "Protocol on Phytosanitary Requirements for the Export of Kidney Beans from Kyrgyzstan to China by the General Administration of Customs of the People's Republic of China and the Ministry of Water Resources, Agriculture and Processing Industry of Kyrgyzstan", from now on, the import of kidney beans from Kyrgyzstan that meet the following relevant requirements is allowed:

 

I. Inspection and quarantine basis

(1) "Biosafety Law of the People's Republic of China".

(2) "Law of the People's Republic of China on Entry and Exit Animal and Plant Quarantine" and its implementing regulations.

(3) "Food Safety Law of the People's Republic of China" and its implementing regulations.

(4) "Administrative Measures for Import and Export Food Safety of the People's Republic of China".

(5) "Protocol on Phytosanitary Requirements for the Export of Kidney Beans from Kyrgyzstan by the General Administration of Customs of the People's Republic of China and the Ministry of Water Resources, Agriculture and Processing Industry of Kyrgyzstan".

 

II. Names of commodities allowed for entry

Phaseolus vulgaris in this announcement refers to the seeds of kidney beans grown and processed in Kyrgyzstan for consumption or food processing.

 

III. Permitted origin

The whole territory of Kyrgyzstan.

 

IV. Enterprise Registration

The production, processing and storage enterprises of kidney beans exported to China shall be reviewed and registered by the Ministry of Water Resources, Agriculture and Processing Industry of Kyrgyzstan, and the Ministry of Water Resources, Agriculture and Processing Industry of Kyrgyzstan shall recommend the approved relevant enterprise information to China Customs. China Customs shall review the production, processing and storage enterprises recommended by the Ministry of Water Resources, Agriculture and Processing Industry of Kyrgyzstan, conduct video inspection or on-site inspection when necessary, and register them after passing. China Customs will publish the list of relevant enterprises on its website.

 

V. Pests of concern

The following pests shall not be carried in kidney beans exported to China:

1. Acanthoscelides obtectus

2. Prostephanus truncatus

3. Zabrotes subfasciatus

4. Peanut mottle virus

5. Soybean dwarf virus

6. Tobacco ringspot virus

7. Tomato black ring virus

8. Diaporthe phaseolorum var. sojae

9. Erysiphe pisi var. pisi

10. Olpidium brassicae

11. Choanephora cucurbitarum

12. Curtobacterium flaccumfaciens pv. flaccumfaciens

 

VI. Requirements before shipment

(I) Production requirements.

1. The monitoring and prevention of pests in the planting areas and production, processing and storage enterprises of kidney beans exported to China shall be implemented under the guidance of professional technicians. During the planting period, weeds should be removed in time, and integrated pest control should be implemented, including pest monitoring surveys, chemical or biological control, and agricultural operations.

2. The Ministry of Water Resources, Agriculture and Processing Industry of Kyrgyzstan shall adopt internationally recognized survey and monitoring methods to conduct epidemic monitoring and pesticide use investigations on pests of concern to the Chinese Customs during the processing and storage period of kidney beans, and submit the above-mentioned pest monitoring reports and pesticide use reports as required by the Chinese Customs.

3. Enterprises producing, processing and storing kidney beans exported to China shall establish a sound quality management and traceability system, strictly screen and remove impurities, and shall not carry deformed, broken, diseased grains, insects, mites, mollusks, soil, weed seeds and other plant residues.

(II) Packaging and transportation requirements.

1. Kidney beans exported to China shall be transported in packaging, using clean, hygienic, and new materials that meet the plant quarantine requirements of the Chinese Customs. Each package shall be marked in English with the words "This product is exported to the People's Republic of China" and information such as the product name, country of origin, and name, registration number, and address of the processing and storage enterprise. If wooden packaging is used, it must comply with the requirements of the International Standard for Phytosanitary Measures No. 15 (ISPM 15).

2. The transport vehicles for kidney beans exported to China shall meet the requirements of hygiene and epidemic prevention, and a thorough inspection shall be carried out before shipment to prevent the entry of harmful organisms.

(III) Product requirements.

Kidney beans exported to China shall comply with the provisions of China's laws and regulations on plant quarantine and national food safety standards, and shall not contain harmful organisms, soil and other living insects of concern to the Chinese customs, and shall not contain weed seeds, plant residues, gravel and other impurities.

(IV) Pre-export inspection and quarantine and certificate requirements.

1. Before export, the Ministry of Water Resources, Agriculture and Processing Industry of Kyrgyzstan shall conduct inspection and quarantine on kidney beans exported to China. For goods that meet the requirements, the Ministry of Water Resources, Agriculture and Processing Industry of Kyrgyzstan shall issue a phytosanitary certificate in accordance with the International Standard for Phytosanitary Measures (ISPM) No. 12, "Guidelines for Phytosanitary Certificates", and indicate in the additional statement "This consignment meets the requirement of the Protocol of phytosanitary requirements applicable to the export of beans from the Kyrgyz Republic to the People's Republic of China, and is free of any quarantine pest concerned to the People's Republic of China", and the name and registration number of the processing and storage enterprise shall also be indicated.

2. If live insects are found, the Ministry of Water Resources, Agriculture and Processing Industry of Kyrgyzstan shall conduct effective quarantine treatment before export, and the treatment index information such as the method, time, temperature and agent of quarantine treatment shall be indicated in the phytosanitary certificate.

 

VII. Entry Inspection and Quarantine

(I) Certificate Verification.

1. Verify whether the "Entry Animal and Plant Quarantine Permit" is attached.

2. Verify whether it comes from a registered enterprise.

3. Verify whether the plant quarantine certificate is authentic and valid.

(II) Cargo inspection and supervision.

According to relevant laws, administrative regulations, rules and regulations, and in combination with Articles 5 and 6 of these requirements, inspection and quarantine shall be carried out on imported kidney beans. If they pass the inspection and quarantine, they shall be allowed to enter the country.

(III) Handling of non-compliance.

1. If there is no valid plant quarantine certificate, they shall be returned or destroyed.

2. If they come from unregistered processing enterprises, they shall be returned or destroyed.

3. If living quarantine pests or other living pests of concern to the Chinese Customs are found, they shall be treated with pest control if there are effective treatment methods; if there are no effective treatment methods, they shall be returned or destroyed.

4. If they are found to be non-compliant with China's national food safety standards, they shall be returned or destroyed.

5. If they are found to contain impurities such as soil, weed seeds, plant residues and gravel, they shall be harmlessly treated, returned or destroyed in accordance with relevant laws and regulations.

If the above non-compliance is found, China Customs will notify the Ministry of Water Resources, Agriculture and Processing Industry of Kyrgyzstan and take measures such as suspending the export qualifications of relevant enterprises to China or suspending the export of kidney beans from Kyrgyzstan to China according to the severity.
