Regarding the Inspection and Quarantine Requirements for Peanut from Malawi to China

According to the regulations of the Chinese Customs and the Ministry of Agriculture of Malawi on the plant quarantine requirements for the export of shelled peanuts to China, starting from now, the import of Malawi peanuts that meet the following relevant requirements is allowed:

 

I. Inspection and quarantine basis

(I) "Biosafety Law of the People's Republic of China";

(II) "Law of the People's Republic of China on Entry and Exit Animal and Plant Quarantine" and its implementing regulations;

(III) "Food Safety Law of the People's Republic of China" and its implementing regulations;

(IV) "Law of the People's Republic of China on Import and Export Commodity Inspection" and its implementing regulations;

(V) "Regulations on the Supervision and Administration of Entry and Exit Grain Inspection and Quarantine";

(VI) "Regulations on the Administration of Import and Export Food Safety";

(VII) "Protocol on Plant Quarantine Requirements for the Export of Shelled Peanuts from Malawi to China between the General Administration of Customs of the People's Republic of China and the Ministry of Agriculture of the Republic of Malawi".

 

II. Names of commodities allowed to enter the country

Peanuts (Arachis hypogaea L.) in this announcement refer to shelled peanuts produced in Malawi, which are exported to China for processing or consumption, not for planting purposes.

 

III. Permitted origin

The whole territory of Malawi.

 

IV. Enterprise Registration

Shelled peanuts exported to China should come from export production, processing and storage enterprises approved by the Ministry of Agriculture of Malawi. The above-mentioned enterprises are recommended by the Ministry of Agriculture of Malawi to the Chinese Customs. After inspection or review by the Chinese Customs, they will be registered and the list of enterprises will be published on the website.

 

V. Pests of concern

Shelled peanuts exported to China must not carry the following quarantine pests:

1. Prostephanus truncatus

2. Callosobruchus maculatus

3. Cowpea mild mottle virus

 

VI. Pre-shipment requirements

(I) Production requirements.

1. The Ministry of Agriculture of Malawi should guide and supervise the production, processing and storage enterprises exported to China to establish an integrated pest control system.

2. The Ministry of Agriculture of Malawi should monitor the Cowpea mild mottle virus of concern to the Chinese Customs during the planting period. If the virus is found, prevention and control measures should be taken immediately to reduce the occurrence of pests of concern to the Chinese Customs.

3. The Ministry of Agriculture of Malawi should ensure that peanut companies exporting to China take necessary screening and cleaning measures before storage or shipment to minimize the carrying of soil, plant residues, weed seeds, other grain seeds, etc.

(II) Packaging and transportation requirements.

Shelled peanuts exported to China must be packaged to avoid leakage during transportation. The packaging materials should be clean, unused, and free of toxic and hazardous substances. Each package of shelled peanuts should have at least one label indicating the company name, registration number, and "从马拉维出口到中华人民共和国的脱壳花生""SHELLED PEANUT FROM MALAWI TO BE EXPORTED TO THE PEOPLE´S REPUBLIC OF CHINA" in Chinese and English. The containers transporting peanuts must be cleaned before shipment.

(III) Product requirements.

Shelled peanuts exported to China should comply with China's inbound plant quarantine laws and regulations and national food safety standards. They should not carry quarantine pests of concern to the Chinese Customs, should not carry soil, and should not intentionally add or mix other grains and foreign impurities.

(IV) Pre-export inspection and quarantine and certificate requirements. Before export, the Malawi Ministry of Agriculture should ensure that each batch of shelled peanuts is tested in the laboratory to prove that there are no quarantine pests: Prostephanus truncatus, Callosobruchus maculatus, Cowpea mild mottle virus. The Malawi Ministry of Agriculture ensures that each batch of shelled peanuts is tested for aflatoxin limits to ensure that it meets the national food safety standards of China.

For goods that meet the requirements, the Malawi Ministry of Agriculture should issue a phytosanitary certificate in accordance with the International Standard for Phytosanitary Measures (ISPM) No. 12 "Guidelines for Phytosanitary Certificates" and indicate in the additional statement: "The consignment meets the phytosanitary requirements described in the Peanut Protocol from Malawi to China and is free from the quarantine pests concerned by China", and indicate the name of the manufacturer of this batch of goods, registration number and container number.

If storage pests or other live insects are found during the storage of shelled peanuts exported to China, fumigation treatment should be adopted, and the fumigation treatment indicators should be indicated on the phytosanitary certificate.

 

VII. Entry Inspection and Quarantine

When shelled peanuts imported to China arrive at the Chinese entry port, the Chinese Customs shall implement inspection and quarantine in accordance with the following requirements.

(I) Document verification.

1. Verify whether they come from registered enterprises.

2. Verify whether the attached plant quarantine certificate is authentic and valid.

(II) Cargo inspection.

1. According to relevant laws, administrative regulations, rules and other provisions, combined with the requirements of this announcement, the entry of peanuts shall be subject to inspection and quarantine. If they pass the inspection and quarantine, they shall be allowed to enter the country.

2. The entry of peanuts shall be subject to inspection and quarantine at the designated supervision site for inbound grain.

(III) Disqualified treatment.

1. If there is no valid plant quarantine certificate or it comes from an unregistered enterprise, it shall be returned or destroyed.

2. If unapproved genetically modified ingredients are found, it shall be returned or destroyed.

3. If safety and sanitation items such as aflatoxin exceed the limit of China's national food safety standards, it shall be returned or destroyed. If other situations that do not meet China's food safety requirements are found, they shall be handled in accordance with relevant laws and regulations.

4. If quarantine pests of concern to China Customs listed in this announcement are intercepted, the relevant goods will be allowed to enter the country after effective quarantine treatment. If quarantine treatment cannot be implemented, return or destruction measures will be taken.

5. If other pests are intercepted, they will be handled in accordance with the relevant provisions of the "Law of the People's Republic of China on Entry and Exit Animal and Plant Quarantine" and its implementing regulations.

If the above-mentioned unqualified situations are found, China Customs will notify the Ministry of Agriculture of Malawi and, depending on the severity of the violations, take measures such as suspending the export of relevant registered enterprises or even suspending the export of Malawi peanuts to China until the Ministry of Agriculture of Malawi takes effective improvement measures.
